United States v. Michael Mincy

Mr. Mincy was charged with a Hobbs Act robbery for conspiring with others to rob a Winn Dixie Supermarket. Several other individuals were sentenced to significant federal prison terms because of the robbery and the theft of thousands of dollars. Mr. Mincy’s guideline range was 46 to 57 months imprisonment.

Mr. Seitles successfully argued that Mr. Mincy was a minor participant in the robbery and unaware that a real weapon would be used in the offense. Mr. Seitles explained that mitigating factors – including Mr. Mincy’s lack of a prior criminal history, youth, remorse, work history and strong family – supported a non-incarcerative sentence.

The Judge sentenced Mr. Mincy to five years probation.
