Jason Cummings v. United States

In a 2255 Motion to Vacate, Seitles & Litwin successfully argued to the United States Magistrate Judge that Mr. Cummings’s drug conviction should be overturned.  Mr. Cummings was found guilty of being involved in a drug conspiracy after trial.  Seitles & Litwin represented Mr. Cummings, an ex-United States Marine, in his post-conviction motion.  After having Mr. Cummings evaluated by a mental health expert, Seitles & Litwin argued that his conviction should be vacated because his trial counsel failed to effectively raise the effects of Mr. Cummings’s PTSD on the case.  The United States Magistrate Judge agreed, recommending that Mr. Cummings’s conviction should be vacated.
